  1. Oliver Grant owns Rosewood Farm, an unregistered freehold estate consisting of a farmhouse, several outbuildings, and surrounding land. Oliver has agreed to sell the property to Charlotte Baker. During investigations, Charlotte discovers the following:
    In 2014 Oliver granted Eleanor Wright a right to use a track running across Rosewood Farm to access her neighbouring property. In 2016 Oliver promised Benjamin Foster that no commercial buildings would ever be erected on part of the estate. Benjamin paid £50,000 in return for this promise. Jacob Turner occupies one of the cottages on the estate and pays monthly rent.
    Sarah Grant, Oliver’s former partner, claims an interest in the property arising from substantial financial contributions towards its purchase and improvement. No relevant entries appear on a search of the Land Charges Register.

  2. William Carter owns a large registered estate known as Meadow View. In 2010 he sold part of the estate to Emma Hughes.
    The transfer deed granted Emma. Right of way over a private road. A right to connect into drainage pipes running beneath William’s land.
    The transfer also contained covenants:
    not to build more than one dwelling on the land;
    to maintain the boundary fence;
    to contribute towards maintenance of the private road. In 2018 Emma sells the land to Prime Developments Ltd., which intends to construct a housing development consisting of six houses.
    Advise William.
  3. 25%. Maria Evans and Lucy Bennett purchased a property together in 2010. The transfer deed states it. The property is transferred to Maria Evans and Lucy Bennett jointly. Maria contributed 75% of the purchase price, and Lucy contributed 25%. Several years later. Lucy grants a mortgage over her interest to Secure Finance Ltd. Maria wishes to sell the property. Lucy refuses to agree. Before proceedings are concluded, Lucy dies.
    Advise Maria, Secure Finance Ltd., and Lucy’s estate.
  4. Christopher Moore owns a converted Victorian building.
    The following arrangements exist:
    Megan Price occupies a self-contained flat under a written agreement for four years.
    Thomas Reed occupies a room but can be moved to another room whenever Christopher chooses.Rebecca Hall signed a document described as a “licence”, but she has exclusive possession of a separate apartment for five years.Christopher sells the building to Harper Estates Ltd, which seeks possession of all parts of the property.
    Advise the parties.
  5. National Property Bank lends £450,000 to Andrew Wilson, secured by a mortgage over his home.
    The mortgage deed provides that:
    Andrew cannot redeem the mortgage for 30 years; the bank may purchase the property if Andrew defaults. Andrew must insure the property through the bank’s subsidiary insurance company. Andrew falls into arrears, and the bank seeks possession.
    Advise Andrew.
  6. Sophia Collins agrees to purchase a registered property known as Oak Manor from Henry Walker.
    Before completion, she discovers the following:
    a seven-year lease granted to Nathan Scott.
